Online Privacy Policy

Kim Knight Health and The Art of Health (the “Company”) respects the privacy concerns of the users of its website, kimknighthealth.kajabi.com and kimknighthealth.com, and the services provided therein (the “Site”). The Company provides this privacy statement to explain what information is gathered during a visit to the Site and how such information may be used.

Use of Information

As a general policy, no personally identifiable information, such as your name, address, or e-mail address, is automatically collected from your visit to the Site. When you sign up for a program or product on the Site you will have the option of subscribing to the email enewsletter list at the same time. This will be your choice to do so or not. If you do choose to subscribe at this time, you have the option to unsubscribe from the enewsletter list at any time - the unsubscribe option is always to be found at the bottom of every email enewsletter. You also have the option to cancel your membership at any time, which you can do from within your dashboard.

Certain non-personal information is recorded by the standard operation of the Company’s internet servers, such as the type of browser being used, its operating system. Your IP address is also gathered in order to enhance your online experience, although this is done automatically by the system and Kim Knight Health does not do anything with this information.

The Site’s various mailing lists, downloads, special offers, contests, registration forms and surveys may request you give:

  • contact information such as your name, mailing and/or e-mail address
  • demographic information such as your age and gender
  • and personal preference information such as your preferred software and interests.

Information submitted at the time of submission will be used by the Company only as necessary for legitimate business interests, including without limitation the improvement of our products, services and contents of the Site.

With your permission, which is given at time of subscription to a program or product, we may use your contact information to send you information via email or program updates about our company and products. You may always opt-out of receiving future mailings as provided below.

Third party sharing

Personally identifiable information is never sold or leased to any third parties. The Company will never share your information with any third party without your consent. Your details, including your name, email address and any other contact information are solely for the use of Kim Knight Health in communicating with you via email enewsletter or the internal online program announcements.

The Company may disclose user information in special cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) with the Company’s rights or property, other users of the Site, or anyone else that could be harmed by such activities.

Choice: Opt in-Opt out

The Site may provide you the opportunity to opt-in to receive communications from us at the point where we request information about you. For example, when you first sign up to the site for a program or product, whether free or paid, you will be asked for certain details, including name and email address, and also country and billing details if relevant. 

You always have the option of removing your name from any e-mail list in order to discontinue any such future communications. The 'unsubscribe' option is always located at the bottom of every email communication.

All programs also include occasional announcements of updates or special events which you can choose to opt in or out of. Please note that if you unsubscribe from a program announcement update, this means you will no longer be notified of any new updates or additional material added to that program!

In order to ensure immediate removal from any list, please follow the specific instructions set forth within the communications you receive from the Company which you no longer wish to receive.

If you are unsuccessful in completing the instructions specified in any such communication, please e-mail [email protected], including a copy of the undesired email attached to the request, and state you wish to be removed from the mailing list. This will be effected as soon as possible, usually within 24 hours, or 3 days if over a weekend, and maximum a week. As a small business the Company appreciates your patience and we promise to respond as quickly as humanly possible.

With every communication you receive you always have an option to unsubscribe and remove yourself from the mailing list. This option has always been available through an “unsubscribe” link in the footer of every enewsletter email.

With every communication you receive you always have an option to unsubscribe and remove yourself from program announcements. This option has always been available through an “unsubscribe” link in the footer of every program notification email. 

Cancel program subscription:

You always have the option to self-cancel your membership in the membership portal at any time, or request the Company do this for you. There are no refunds for any programs once purchased as stated on the terms and conditionsof this Site.

Storing of billing details

The Company does not store any credit card information it may receive in regard to a specific transaction and/or billing arrangement except as necessary to complete and satisfy its rights and obligations with regard to such transaction, billing arrangement, and/or as otherwise authorized by a user.

Children Age 13 and Under

The Company recognizes the special obligation to protect personally identifiable information obtained from children age 13 and under. AS SUCH, IF YOU ARE 13 YEARS OLD OR YOUNGER, THE COMPANY REQUESTS THAT YOU NOT SUBMIT ANY PERSONAL INFORMATION TO THE SITE OR TO THE COMPANY. If the Company discovers that a child age 13 or younger has signed up on the Site or provided us with personally identifiable information, it will delete that child’s identifiable information from the records.

The Company nonetheless encourages parents to go online with their kids. Here are a few tips to help make a child’s online experience safer:

  1. Teach kids never to give personal information, unless supervised by a parent or responsible adult. Includes name, address, phone, school, etc.
  2. Know the sites your kids are visiting and which sites are appropriate.
  3. Look for Website privacy policies. Know how your child’s information is treated.

Use of Cookies

Cookies are pieces of information that a website transfers to an individual’s computer hard drive for record keeping purposes. Cookies make using our Site easier by, among other things, saving your passwords and preferences for you. These cookies are restricted for use only on our Site, and do not transfer any personal information to any other party.

Most browsers are initially set up to accept cookies. You can, however, reset your browser to refuse all cookies or indicate when a cookie is being sent. Please consult the technical information relevant to your browser for instructions. If you choose to disable your cookies setting or refuse to accept a cookie, some parts of the Site may not function properly or may be considerably slower.

Facebook 'pixel'

A Facebook pixel is a tiny piece of java script code that may be incorporated into web pages. This piece of code provides a series of functions for transmitting application-specific events and user-defined data to Facebook.

The Company sometimes use Facebook pixels to record information about the way visitors use the website. This pixel records information about the user's browser session, which it sends to Facebook, along with a hashed version of the Facebook ID and the URL viewed. Every Facebook user has a unique, device-independent Facebook ID that allows us to address and recognise users across a range of devices using the Facebook social network, so that the Company can address visitors for commercial purposes using Facebook ads. No personal information about individual visitors to the website will be disclosed and the Company can only advertise to website customer target groups in a targeted way once the customer target group has reached a critical mass. This makes it impossible to discover the identity of visitors.

For GDPR clarity, in regards to Facebook pixels, Facebook is both Data Controller and Data Processor. 

Malware/Spyware/Viruses

Neither the Company nor the Site knowingly permit the use of malware, spyware, viruses, and/or other similar types of software.

Links to External Sites

The Company is not responsible for the content or practices of third party websites that may be linked to the Site. The Company is also not responsible for any information that you might share with such linked websites. You should refer to each website’s respective privacy policy and practices prior to disclosing any information.

Bulletin Boards and Chat Areas

Members of the Site are solely responsible for the content of messages they post on the Company’s forums, such as chat rooms, bulletin boards and posting 'comments' inside the programs. Currently there are no chat rooms or bulletin boards, only the ability to post 'comments' inside programs. These comments are only visible to other members of the program where they are posted, and not visible to members of any other program within the site or publicly visible outside the Site.

Users should be aware that when they voluntarily disclose personal information (e.g., user name, e-mail address, phone number) in these public areas inside the Site, that information can be collected and used by others and may result in unsolicited messages from other people. You are responsible for the personal information you choose to submit in these instances. Please take care when using these features.

As a result, while we strive to protect your personal information, The Company cannot ensure or warrant the security of any information you transmit via the internet. By transmitting any such information to the Company, you accept that you do so at your own risk.
